Intervention Committee & IIC Interventions
The IIC Intervention Committee was officially formed in 2018 with a mandate to identify cases that are considered particularly important to the profession and consider the appropriateness of intervening in these cases, either as a party to advocate for a particular position or as an amicus curiae to inform the Court on the implications of the issues raised in the cases as they pertain to restructuring or insolvency proceedings.
The committee considers interventions based on various criteria such as whether the issue has national importance or implications, impacts upon established insolvency practice, or concerns the objectives of federal insolvency legislation. The committee focusses particularly on cases being heard by the Supreme Court of Canada (SCC) and, in some instances, appellate courts. The committee is responsible for formulating a recommendation for the board regarding any proposed intervention and strategy.
IIC members and their colleagues donate their time and expertise to serve as counsel for the IIC on a pro-bono basis.
To date, the cases in which the IIC has intervened are as follows:
*All firms listed are the member’s firm at the time of the intervention.
The Intervention Committee welcomes submissions from members of the commercial restructuring and insolvency community recommending cases in which they believe the IIC should consider intervening.
Please fill out the online submission form below with an attached service list and primary participants on the issues and the relevant decision. You can also download the Intervention Form in PDF and email it with any corresponding documentation to the executive director.
All submissions will be reviewed by the Intervention Committee and a recommendation will be made to the IIC Board of Directors. Please enter n/a in any field where information is not available or relevant.
